Before signing contracts, get a vexatious litigants list. The vexatious litigant is typically describes as an image of someone who represents himself/herself to file zillions of groundless lawsuits mostly intended to harass an adversary. Most of these cases however were dismissed in court and litigants are ordered to be listed in the vexatious litigant list.

Victims of the Statute

However, in a few isolated cases, some may have been true. Those cases that were published were also the cases that heralded the bar associations to lend dignity to the statute, where one can choose to represent oneself in court. It was the bar associations that originally sponsored this statute and must only apply to individuals who fail to hire a lawyer.

While this statute was intended to serve ordinary people, the reality however is very different. In the vast majority of the cases and court records, it is the ordinary and simple people who fall victims of the vexatious litigant statute.

The Judicial Council’s blacklist or the vexatious litigants list has a list of people who did nothing vexatious at all. They are just too poor to hire a lawyer. Some of them have not even been involved in litigations before.

Most of them are even the defendants in the action contrary to the letter and spirit of the statute that was intended to protect the defendants and not the plaintiffs.

But be warned, there are also people in the list who are also known as truly malicious in filing lawsuits in any form.

The list of Vexatious Litigants

The vexatious litigants list can be acquired from the Judicial Council and the Administrative Office of the Courts, a designated staff agency of the courts. This office is also known as AOC. This agency is task to record, file and disseminates an updated list on a monthly basis of the current vexatious litigant list. The list includes personalities since 1991. You can secure a copy of the list from this office. However, the names before 1991 are not anymore included in the list.

Furthermore, please take note that if a person has been declared a vexatious litigant, but lacks a prefiling order from the court, their names won’t appear in the list. Moreover, if there is an order that only requires posting of security but without a prefiling order from the court, the name will not also be listed in the vexatious litigants.

Before signing any contract, agreement, or make a decision to choose a contractor, subcontractor or an artisan, you must complete a brief background check and include the vexatious litigants list in investigation.
